Terms of Service

By accessing or using peakdrop.gg ("the Site," "PeakDrop," "we," "us," "our"), operated by PeakDrop LLC, a Wyoming limited liability company, you ("User," "you," "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.

We reserve the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or site notification.

You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is higher) to use PeakDrop. By creating an account, you confirm that:

• You are at least 18 years old
• You are legally permitted to use the Site in your jurisdiction
• You have not been previously suspended or removed from the Site
• You are not accessing the Site from a restricted jurisdiction (see Section 12)

We reserve the right to request identity verification at any time. Failure to provide verification when requested may result in account suspension.

• One account per person. Multiple accounts are prohibited and will result in termination of all accounts and forfeiture of any items or balance.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity on your account.
• You must provide accurate, current information during registration.
• You may not sell, transfer, or share your account with any other person.

PeakDrop is an entertainment platform that offers gamified e-commerce experiences. Users purchase access to interactive product experiences ("Towers," "Battles," "Deals," "Draws," "Gauntlets," and other game modes) where outcomes determine which products are received.

IMPORTANT: Every interaction on PeakDrop results in the user receiving a product or voucher. There is no outcome where a user receives nothing. All product experiences are randomized using a provably fair system (see Section 7).

PeakDrop is NOT a gambling service. We do not offer games of chance where the participant risks losing their entire consideration. Every purchase results in the delivery of goods.

• Deposits are made via cryptocurrency through our payment processor (NOWPayments).
• All deposits are converted to site credits ("Balance") denominated in USD.
• Minimum deposit amounts may apply.
• Deposits are non-refundable except where required by applicable law.
• We are not responsible for cryptocurrency price fluctuations between the time of deposit and confirmation.
• You are solely responsible for ensuring that cryptocurrency transactions are sent to the correct wallet address.

Products and Vouchers: All items available on PeakDrop are real, physical products or PeakDrop site vouchers. Product prices reflect approximate retail market values at the time of listing.

Inventory: Products won through any game mode are added to your Inventory. You may sell items back for balance, request physical delivery, or use items in other game modes.

Physical Delivery: Available to users in the United States and Canada. Delivery times vary (typically 7-21 business days). We reserve the right to substitute a product of equal or greater value if unavailable. Risk of loss transfers upon delivery to the carrier.

Withdrawals: You may withdraw your Balance as cryptocurrency. Minimum withdrawal amounts may apply. We may require identity verification (KYC) for withdrawals exceeding $500. Processing: typically 1-24 hours, up to 7 business days.

All game outcomes on PeakDrop are determined by a provably fair algorithm using HMAC-SHA256 cryptographic hashing. A server seed hash is provided before any game begins. You may set your own client seed. After each game, the raw server seed is revealed so you can independently verify that the outcome was not manipulated.

PeakDrop publishes the odds and potential outcomes for every game mode. Tower floors display collapse probability. Draw tickets show win probability. Deals show upgrade probability. All drop rates are viewable before purchase.

The expected return varies by game mode. Users should expect that the average value of items received will be less than the amount spent. PeakDrop is an entertainment service, not an investment vehicle.

You may NOT: use the Site if under 18; create multiple accounts; use bots, scripts, or automated tools; exploit bugs or errors; collude with other users; use the Site for money laundering; engage in fraudulent chargebacks; harass other users or staff; share account credentials; or use a VPN to circumvent geographic restrictions.

Violation may result in immediate account termination and forfeiture of all items and balance.

All content on PeakDrop is the property of PeakDrop LLC or its licensors. Product images are used for identification purposes and remain the property of their respective owners.

To the maximum extent permitted by law:

• PeakDrop is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed deposits in the preceding 12 months.
• We are not liable for losses from cryptocurrency volatility, network failures, or third-party errors.

PeakDrop is not available in: Washington State (USA), Belgium, Netherlands, Australia (certain states), or any jurisdiction where such services are prohibited. Users are responsible for ensuring compliance with local laws.

Disputes shall be resolved through binding arbitration administered by the American Arbitration Association in Wyoming, USA. You waive any right to participate in a class action lawsuit.

We may suspend or terminate your account for violation of these Terms. Upon termination for cause, unredeemed items may be forfeited. If termination is without cause, you will be given 30 days to withdraw Balance and claim items.
